Urgent: 485 Denied and working on EAD.. Please help....

Hello all,

My wife's 485 got denied today. PD 07/2006. She switched employers while on EAD and is currently working for a new employer on EAD. I am still continuing on H1. Her former employer canceled the H1.

I just got the email today, reasons not known yet.

What do we do now ? Any pointers would be highly highly useful.

Motion to Reopen

Contact a good immigration attorney. If 180 days have passed after filing 485 during the employer change, then AC21 will give protection. You may have to wait for the notice from INS describing the reasons for denial etc., The key is contacting a good attorney and filing the motion to reopen based on further evidence of employment.

I think, you should not have any problems. The reason, you are still on H1 and she can switch back to H4 from EAD.

However, please check with your lawer at an earliest.

My lawyer wants to see the letter with reasons for denial.

In the mean time, I talked to the second level officer just now. He was saying that it may be a computer error as he is seeing no update to the case. I just wish he is correct, but may be I am too optimistic.

Some more facts on the case.
- I140 was not revoked.
- H1 was canceled after she changed employers.
- She changed employers 7 months after 485 was filed, but 3 months after I-140 was approved. SO, she got the EAD and AP and only then got the I-140 approved.
- I see a LUD of 05/06/2008 on the I-140 and 485 , which is today.
