Uregnt need help about H1B status-little different situation

Hi,
I had a H1-B visa with company A valid for three years. But only worked with that company for one year and start working with company B. But I did not transfer my visa to company B until 8 months later, because my attorney at that time did not tell me that I need to transfer my H1-B to new company every time I change my job. She told as long as my H1-B is valid I am ok ( now I know she was not right)

But now I am working with company C and have a valid H1-B with the current company. I am getting my green card through counselor processing. My present attorney said that CP is the only way I can go for GC.

My question is am I going to have any problem in CP due my over stayed H1-B status. My attorney don’t think so and he said since I only accrued unlawful present and not illegal present.

I need help if any body has the same situation or if somebody can give me advice or opinion I am going for my CP interview in May 27. its very urgent.

In my opinion, I guess your attorney is right. Since your H1 was valid, from your CP standpoint it should not create any issue.

Since, you got the visa transfered for Company C, it shows that there is not illegal stay on your name ..
