Upgrade from EB3 to EB2

Hi,


My employer filed my labor under EB3 category in the month of Nov 04.Now Can i upgrade it to EB 2?My Qualifications and job requirements both fall under EB2.My Employer says he is going to upgrade it in PERM So that i can file 140 485 concurrently.Can i do it now instead of waiting till PERM?

There is no such thing as upgrade, you have to withdraw your earlier Eb3 case and file a new LC in EB2. You can apply in RIR until March 27, 2005 after that you can only apply in PERM.
