UPDATE ON JULY VISA AVAILABILITY

The sudden backlog reduction efforts by Citizenship and Immigration Services Offices during the past month have resulted in the use of almost 60,000 Employment numbers. As a result of this unexpected action it has been necessary to make immediate adjustments to several previously announced cut-off dates. All Citizenship and Immigration Services Offices have been notified of the following:

Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation

have been made available. Employment preference numbers will once again be available to these chargeability areas beginning October 1, 2007, under the FY-2008 annual numerical limitation.

Department of State Publication 9514
CA/VO: July 2, 2007

I read this from www.immigration-law.com:

"If visa number is unavailable in the Visa Bulletin, it appears that the USCIS is unable to accept the 485 applications under the USCIS regulation. It is thus likely that all the applications which they received or will receive today may be rejected and returned."

"This Visa Bulletin revision also implies that there will be no EB-485 approvals during July, August, and September 2007!!!!! Accordingly all the recent approvals practically ended as of July 1, 2007 and there will be no adjudication of any employment-based I-485 applications."

It seems like USCIS will not be accepting any more I-485 applications for all employment based categories and neither will they be approving any employment based I-485 cases until the end of September 2007.

ya .. I know .. the BIG Game is over .. anyway personally I feel that we are wasting our precious time here running for gc .. time to think seriously to go back ... these stupid people will never change .. they will never look their back how they are here !! We never wanted to see all EB category become available in one day and disappear on the day before (you can see only in usa)!!

Keep up the hope!!!

I think USCIS acted more under pressure to prove to DoS that there are enough applications to consume the visa numbers and they cannot take more applications. DoS was forcing the USCIS to take the applications to consume the numbers by making the numbers current. USCIS said "Wait a minute. We got enough applications and we are gonna prove it to you". So, they processed a bunch of petitions a lot earlier then they would have and asked DoS to release rest of the numbers. DoS did that and said "that is it... we have no more numbers". What USCIS did so far. They converted part of the numbers to approvals and assigned the rest to the pending applications. Why do I say this way, instead of no more GC approvals? Well, I called USCIS a good couple of hours after these developments. They mentioned about all the recent changes and mentioned "we are processing AOS applications in the order they were received". As every one could guess, there is no way USCIS could approve 60000 applications in one month (more than 2000 a day if they had worked all the days). Also, USCIS has not mentioned that the number have been convereted to GCs, at least, not yet!

So, no new applications. True. Approvals for already existing one. Very likely (high probable)... depending on the number of pending petitions. I am very positive.

You can interpret any which way you like... but I like my theory :D
