Update on Company Name Change

Just spoke to an IIO this morning. According to her, VSC has not yet received any "guidance" from HQ on how to process company name change cases. Also, according to her, filing of pro-active I-140 redo\'s by the employer is not going to help - the applications are still going to be on hold till the actual guidance from HQ shows up. Also, for those who get RFE\'s, the applications will be put on hold as soon as the replies are received for the RFE.

So all company name change guys (IGTE/Mastech), we are going to be sticking around for some more time!!!

I just spoke to IIO and got a different feedback - was more reassuring. I have posted the details under

I truly hope the person I spoke to was right..

Incidentally, I am also from the IGTE/Mastech family. My Emp ID showed up on the list published last friday (4/20/01).

thinking around I feel what the IIO I spoke to could be right - probably that is why our Legal Dept decided to resume filing 140 after lying low for so long. If they feel in anyway that redoing 140 would not help I am sure they would not waste their money on it. What do you feel?

The IIO I spoke with some time back told me that the case will be on hold until guidelines are issued, and also made a remark that the company should have filed the amended I-140 when the company name was changed in APR 2000. This would have prevented all these cases from going on hold ( per the IIO ).
When I talked with a very helpful person at HQ I was told that the guidance was given to VSC, though the guidance is officially due in mid-May.
Looks like VSC is trying to apply the \'Divide-and-Rule\' policy. I think it is a strategic plan to keep everyone confused. Approving some cases while keeping others on hold. In the last few weeks however some company name changes have been approved. However hard I try, I am not able to reason why VSC would want to hold some cases while approving others. Any ideas ?
So depending on who you talk with there doesn\'t seem to be any consistency in either the dates, the actual guidance and the action being taken by different folks at VSC. I just hope VSC will approve all these hold cases without further delay.

and when did you talk to that person ?
I\'m in same situtation, company name change, lawyer wouln\'t re-do 140, keeps
saying no need to!

it is me again,

I just called VSC and talked with a nice lady... she said that this week my case WAS FINALLY ASSIGNED to an officer (when I called last week - it was not assigned)

I asked whether it is/was put on hold for any reason and got an answer that is not on hold (she take a pause to check smth before answering this question)... certainly it can be put on hold later - but at least it was not put on hold so far due to our Mastech->iGate story :-)

when I asked about potential time frame for the case to be considered by an officer, once it was given to him - she replied that it can take up to 90 days or even 120 days

Not exactly what you are looking for, but here is what I learnt.

I couldn\'t get his name, actually I wasn\'t paying much attention to this because all my previous calls to HQ always led me someone who wasn\'t sure about the guidelines. I talked to a different person
everytime I called INS HQ. And I must have called atleast 5-6 times. But a couple of days back when I called INS HQ and asked to be connected to anyone responsible for issuing guidelines and policy I was connected to this person (after a few minutes wait). He was very patient, he heard all I had to say about the hold cases. When I asked him if he knew when these guidelines will be issued he looked up a list which he had and said that the AC21 guidelines are due out in 2-3 weeks. He also mentioned that he will talk to and \'instruct\' the folks who are responsible to issue these guidelines on AC21 about these hold cases.
Having already spent more than 10 minutes on the phone with him I thought I should put an end to the conversation before he runs out of his patience. After putting the phone down I realized that I had actually forgotten to take down his name.
So anyway that\'s the story, I wish what he said is true and that VSC does receive and implement these regulations soon.
