UPDATE :: EB3 Visa numbers

Dear Friends,

Last evening, I had a very cordial discussion with an Immigration officer @ TSC (ofcourse this is my first experience to get such a nice friendly person). Even though she refused to answer any questions that was specific to my case (She classified that as status inquiry and I shouldn't call TSC for such things), but she did give some good insight

Q. Is it true that EB3 visa numbers has been exhausted.

A. Yes it is. However for all the case that an adjudicating officer has in his queue is assigned with a visa number. If any such case is rejected, visa number will be made available to the next in line

Q. When do you expect to receive the next lot of Visa Numbers?
A. Wouldn't know, may be tomorrow, may be next month, may be next year.

Q. Mam, I think this is little vague, can you be more specific.
A. I wish, but I don't know.

Q. If Visa numbers are exhausted, why is the July bulletin says all EB category is current.
A. Good question and we wonder the same. However it could be a possibility that ROW may have ample left and it will not be made available unless ROW is current.

Q. When do we know for sure, its true?
A. Ha ha ha...when you see your approval.

Q. When do I see my approval?
A. Ha ha ha. Well, again that's a specific question to your case that I can't answer. Don't try to trick me.

ROW - Rest of the world. There is a country limit for every year, if it goes over that limit it has to wait for ROW spill over.

Kishore, I am not clear whether you meant EB3 visa numbers are exhausted only for India or also for ROW. can you clarify? Thanks!
 
I believe, EB3 for India. ROW can't be exhausted, since July 1st its becoming current.

Bottom line is, I believe there is no reason to Panic as certainly Visa numbers will be available for atleast a month. Question is, ARE YOU GOING to BE ONE ?
 
How do you know whether your case is in

How do you know whether your case is in an officer's queue? if the ones in the officer's queue already had a visa number assigned? can you get that info in the infopass or you have to call TSC?

Yes you can find out, if you call TSC or infopass and the IO is willing to provide you with that information. I was told once, it was sent to the staging area to be assigned to an officer a month back. As of now, nothing happened
 
Relax guys, there is plenty of numbers for our EB3 Pedning cases Hunger .

Hear is the logic.

June : Until this point they can only approve the cases whose PD is current and all the name checks were completed. However they should not consume the visa numbers above and beyond the per country/Per catogory limit. Which is (140000*7% Country* 28 % for EB3)

July
In this quarter, the per country limit does not apply. so they will assign all the free visa numbers of 2007 to the 485 Pending cases. The reason they made current is, to adjudicate all pending applications irrespective of their PD/RD. They are just trying to be smart and creative.

Recently stated there were 70K visa numbers unused, if they dont make it current.

Kishore_l, Got the news that all the applcations were assgined to the Immigration officer for adjudication. So for now every one had the visa numbers for now.
 
Call TSC...

and hope the IO will give you that info - basically that your file has been assigned to an officer.

Hey, the rumors for visa number getting exhausted may be true.....

With so many immigration reps - saying this so often - I am thinking that the 10K quota for India/China etc.....may be finished...

Since from July 1, ROW quota is gonna bleed into India/China....may then the visa numbers should come again....
From July 1, India/China etc will get a free share of the outstanding 40K-70K visas not used by ROW...

I am thinking - when the reps are saying the quota has been used - they must be referring to the 10K annual limit (7% of 140K) for India / China!
WoW - if that's the case, if it had not been for ROW quota being free, the India EB3 would have gone UNAVAILABLE....Interesting!!!

or Be Pro-active and reach out to every help that you can get. Basically, what I am seeing is last time before retrogression I had so much hope to get it approved before 2005, when several friends (applied way after me )of mine got approved way ahead of me.

There are 2 ways
a. sit and hope to get it approved some day, as I was doing so far
b. reach out to every help you can get or file WOM.

Body, I need yr opinion in here. Over the phone with an officer in VSC, I was told that my case was in security checks in one agency outside of USCIS. They were waiting the results to act over my case. Ok, I got LUD in 05MAY07and 22MAY07. ON 24MAY07 I got email from CRIS that they send an RFE. On 18JUN07, another email from CRIS saying that they received my RFE response and to wait 60 days.
Q: Do you think I`m in the QUEUE [I don`t know exatly the meaning]
and I have already a visa # for my GC if approved?
Q: Do you think I still have to be assined to an adjudicator officer?

I have a feeling that yours should be approved soon or atleast in the staging area with an officer. Its highly possible they would have initiated an inter-office / intra-agency (most probably IBIS or BCIS) RFE, which you wont get a copy and they would have responded. Keep your hopes up
