Until yesterday, I wrote to my lawyer (from the biggest immigration firm in the US) asking her for help and advice. This move happens in light of the Indymac incident where all H1B holders who got let go have to be deported. Since both my husband and I in finance with a 4month old baby, I feel compelled to be proactive and perhaps to play the sympathetic card. God forbid if one or both of us got let go, we are not sure if we'll be out of status. most importanty, we have a house here and can't file unemployment claims. so i sent her an email @ 4:30pm which she never replied. And when i got home, i received a CRIS email timestamp 5:45pm that my 'card production is ordered'. I don't know if this is just a coincidence or if she has some correspondence at USCIS!!?? My child and husband case are still pending ....

How is this legally possible?

While its comforting to hear 485 approval out of the way on humanitarian grounds (as far as I understand),

This situation can happen to any of us and I believe its good to know our options.

Can anyone add some clarify how this is legally possible to approve a 485 when no PD is current?
