Unsolicited I-140 redo counted as regular I-140 ???

Folks,

There is a "hypotheses/thought/" I have come across about I-140 redo that is unsolicited, i.., sent by attorney/applicant with explicit I-140 redo RE by INS.

The thought is that such I-140 can be counted as a regular I-140 and thus will be entered in the regular I-140 queue. Consequently, it will face the I-140 hold that is on right now and it will take significantly longer than a regular I-140 redo.

Any thoughts on this? Any messages in the forum you have seen?

FYI.....they have started processing I140s in VSC. Evidence: murthy.com bulletin.

And as far as I know/heard those are not considered as regular I140s

Actually my lawyer says, I485 related changes to I140 are processed separately from regular I140. The fact that I140 redo might be taking longer is the fact that INS is not clear (because new regulations are being reviewed) on how the new law (s.2045) affects them. Contrary to the past where I140 redo were processed almost current, they now take 3 months and possibly more. Is s.2045 really helping us yet? phew.. This is ofcourse unfortunate but that\'s life atleast per INS attitude...

Personally, S.2045 law may not help me much (ND 02/00, EB3 India) as I get closer to approval and I got excited for nothing when it actually becase the law of the land! But that\'s just my opinion

Thanks for your comments. Please note that I am talking about a special case where the INS has not asked for I-140 redo but the lawyer/applicant sends a pro-active (?) I-140 amendment.

I have applied for voluntary I-140 redo. My lawyer told me it would be processed separate from the regular I-140 redo.

My lawyer said that unsolicited I-140s are pretty much a waste of time. It does not stop VSC from asking for a I-140 redo anyway, since
there is no linkage from your I-485 app to your new I-140.

This is also echoed by other people in this forum (e.g. mera_kya_hoga)
It has been rumored that you can apply for a new I-140, speak to
an IIO and get the new I-140 application to be treated just like a redo.
