My I-485 has been filed a month ago. Currently on bench w/ pay but don\'t know how long can my employer withstand it. Can I file for a vacation without pay? If I can, how many months are allowable to get a vacation without pay?

Appreciate any info on this matter.

Once the I485 has been filed, you do not need paystubs to be on status. You can stay here till a decision has been made. Hopefully by then, you will have a project.

Thanks Venkatesh. Problem is my employer wants to stop paying me while I\'m on bench. And that is illegal for an H-1B worker so he\'d rather lay me off than put me on bench without pay. Does this still apply even after filing the I-485?
 
Not if you have a EAD!!

If you have applied for EAD and is approved, then try to look for a job in similiar classification as
defined in you LC.

That\'s what I\'m planning to do. Question is, if my employer lays me off, does that mean the petition is automatically cancelled?
