Unpaid salary

Hi,

I was working on H1 visa for a consulting company. I joined this company thru one of my friedns. My friend, also an employee of this company, used to look after all administrative stuf like rate,client,vacations,health insurance.

I agreed to pay x amount to company as profit margin and y amount to cover health insurance and employer side taxes. This worked out for 18 months till my friend left the company.

After that my employer has deducted my salary for 3 months saying that I and my friend cheated him .Th e(x+y) amount should have been company's profit margin and my health insurance was not deducted . So I have to pay it at a time for last 18 months.

I have the paystubs showing the rate I should be getting.I also have the client's timesheets with the hours on it.But I dont have any written contract with th ecompany.Can I do something to get my unpaid salary back? I am on H1 with another company now.

I also made a mistake by going ahead with this company for GC. My employer deducted $2500 as a GC processing fees for first stage saying that total GC processing fees is $7500. Now as I have to leave his company, I have lost both the GC and money .
He has not given me any details abt the processing for which money is deducted.Is there any way out to recover this money also ?

Possibly, but the situation is too complex to address here. You need to contact an attorney who is licensed in the state that governs your situation (it may or may not be where the company is located).
