I am a US citizen. I have applied for my sister and her son for family based green card in 1997. My sister got her visa and has been in US since May of 2008. At the time of her interview for visa on Jan. 2008 her son didn’t go with her because thinking that he was over 21 years old. He was 26 then. So her son is still in China. Now her son wanted to come over to US. Can he still find his mothers file and try to apply for the interview for his visa?
If my sister has to re-file for her unmarried son over 21 using her Green card holder status, then how long will it take for her son to come?
