I am in my 7th year H1 B, got a 3 year extension based on my I140 approval, i have mistakenly accured less than 180 days of unlawful presence in US staying on a expired I-94 issued at POE. I am planning to go to Chennai for my Visa, i wanted to know on your experiences what are my chances of getting a visa and what type of questions can i expect at the consulate.

Please share your experiences if any one was in the same situations.

Explain how you incurred unlawful presence in the country. expired I-94 doesn't explain much. did you mean whilte I-94 issued at POE is expired? But you should have I-94 attached with your h1-b extension approval? If that's the case then you are fine. you have been misunderstood or misguided if that's what your concern is or else explain your situation in detail.

Here is how i accured unlawful presence

Working for X i797 and I94 valid until Nov 2003 to Nov 2006, Joined Company Y Feb 2004 i797 and I94 valid until Feb 2004 to Jan 2006 my 6 years ends in Jan 2006 without taking into consideration of more than 6 months i was out of US on vacation ( mistake by paralegal while filing Company B H1) . Had to travel during Feb 2005 to india when returing to US at POE while I94 was issued valid until Jan 2006 (still working for Company B).

At this point i am joining Company C in May 2006 attorney advised me that i am unlawful presence from Jan 2006 to May 2006 but Company A I94 is still valid until Nov 06.

Now i got a approval from company C going to Chennai for stamping.

Was anyone with this similar situation problem. I know it is people who went to CBP office while in US and had extension their stay ( new I94) in this scenario.

Appreciate any inputs.
