Can a pharmacist move to his employer’s another store, which is 80 miles away from the present store where LC applied, after I-140 approved and 180 days of I-485 pending?
1. If yes what would happen to the labor that have applied?
2. Do we have apply another labor from the new location?
3. What would happen to the PD?
4. Do we have start GC process again after moving to another location?
5. Because the Labor is aplied from previous location(old store), I have to come back and work at old store after getting GC?

Please we need your adivice to know the impact on curent GC process.

baby: going to another location is bad advice? I did not understand, could you please elaborate on this?

UN: Greencard is for a future job. As long as you had intention and job was in the same metropolitan area upto 180 days of 140 pending then what you do afterwards is no issue in regards to location.

baby: six months back, 140/485/AP/EAD concerently filled. 140/AP/EAD are approved. 485 is pending because of retrogre.....

UN: In your situation; 140 is approved, 485 o/s for more then 180 days, you can invoke ac21 to move to the other location.

Baby: Can we still use AC21? As far as my understanding AC21 can be used when we move to another company after 180 of 485 pending.

UN: The odd time, USCIS will issue an RFE, more on the 140 not the 485, regarding why/when will employee move to location of the employer. There was an excellent AAO decision that came out last year that stated one can use ac21 for same/similar job for the same employer but at a different location.

Baby: You are scaring me here. Why would USCIS issue a RFE about 140. 140 is already approved. In my case, company is not moving me to new location. We want to go 80 miles south because of personnel issues, and we already tald to the employer and the employer also agreed as they have openings there. SO IN THIS CASE HOW THE EMPLOYER CAN ANSWAER TO THE RFE, INCASE IF USCIS ISSUE A RFE.Do we have to drop idea of moving because employer is not moving us? Please help?
