I worked in the University. University filed EB1B and I-485
concurrently Nov. 2004. I also filed EB1A by myself. Both 140 petitions
are approved by Aug.2005. I-485 is pending attached with the EB1B which
is employment dependent.

Questions:

1. I may enounter the problems of switching from one group to another
with same kind of permanent position. Just changing from working for
one professor to another professor. But, I will remain in the same
department and same University. Does this change belong to the category of "Changing the employer"? Will this change affect my I-485 which
is attached with EB1B?

2. If my I-485 is affected, I may need to transfer my I-485 to EB1A. If
so, when shall I transfer my I-485 to EB1A? Will this transfer delay
the approval of I-485?

Your experience and comments will be highly appreciated!

Thank you very much in advance!!!

Thank you! It is a little bit confusing here.

In the I-140 approval, the petitoner is "University of xxx". In the I-140 form part 5, "additional information about the petitoner" all information filled was about the University. But, in the last page of I-140 form, Part-8, Signature, "petitioner's signature" was signed by my current professor/boss, not by the office which was preparing/filling the form and petition.

So, who is the petioner, Univerisity or my current boss?

Hi 485NSC,

The signatory for the Petitioner could be any authorised person by the University (Petitioner with legal entity). The signatory can be someone from the office or the Professor or the Boss.

Good luck with the new Professor/Boss.
