I need your CPA expertise here.

2nd rfe on I-140:
1. Again, we request you submit legible complete copies of your 2001, 2002, 2003, 2004 Corporate Tax Returns. Please do not send any more audited finanical statements.
(Well, i already did, send a Statements of Assets and Liabilities and Equity,Statement of Revenue and expenses, Statement of Cash flows for these years.. 2001-2003 it was a sole proprietorship, 2004 it became a corporation: any suggestions)

2. Please also include the beneficiary's W-2 for the last year and pay stubs for the last six months.
(I already submitted documents that I was on a valid F-1 visa till december 2004, and I joined this company this year in jan 2005, although labour certification was issued back in 2001, but i wanted to finish my degree , so that why i applied for I140-I485 till last year. I did submit pay stub for jan- march 2005. I never worked last year because i was on F-1. How hard is that to understand.

3. Please also submit a complete(front to back) copy of all passports issued in your name.
Okay, no problem.. will submit that again!

RFE on wife's I485:
1. Since the principal employment status is not clear, please submit an I134 and supporting documents showing financial support.
2. Please submit a photocopy of the principals current employment letter. This letter should be on the current company's letterhead and should attest to the principals job offer or continued employment. This letter should also state his or her level of compensation.

(anyone can explain this in simple english)
 
yes, I had a bachelor degree in Computer Information System from an american college.. and I do meet labour certification requirements.

Can you explain to me, question number 1. What does the immigration officer mean by Again, he also bolded Corporate Tax returns. What else is included in tax returns, and then he mentions do not send financial statements.

pls clarify...

The company does all its accounting work from a outside CPA , and he does all the statements and balance sheets.. Is that what you mean by audited?

Sole proprietorship 2001-2003 , the other employees were paid by 1099 and the company was a small starting company but it showed profits each year.

2004 the company came into corporation... all three employees went on W-2 and the company made profit.

Is this an answer to your question.

where do i get it audited and where can i get a receipt for tax returns.. because my desi employer is not educated... so i have to do all myself.. i have copies of my company financial statement for 2003 and 2004 if you want to see it..

the lawyer actually,, took a lumpsum money when filing I140/I485 and now when i asked him, he says I am a lawyer not a CPA,, he say i can only send what you send..O.k let me seach the vermont forum for the ability to pay thread... but I still dont understand what is audited... and where do i get it audited and do I have to show something which is received from the IRS.

I would like to thank united nations...I read your article on ability to pay.. I am getting this stuff in my head now.. I called my company accountant, and he says he has the copy of the tax return for 2004 but 2001- 2003 it was sole proprietorship.. so there is no tax return for the company but a tax return from the owner...ie sole proprietorship... should I send the tax returns of the owner of the company for those years... since he is the sole propriotor or just last year company tax return to uscis and mention the above... I will mail you a copy of the tax return for the company.. and you can find out if I am eligible..

remember we are 4 employees including me.. two americans and 2 desi and the other desi I140 got approved last year without any rfe and his I485 has been tranferred from texas to vermont.
