I had my I140 approved (Sub. labor) a few days ago and my I485 has been pending for more than 180 days. I'm currently employed with a consulting company in the midwest and my H1 is valid for one more year. I have an approved EAD as well. I don't foresee 485 approval anytime soon as I'm EB3 (retrogressed country).

I've been getting a lot of calls for contracting opportunites and hence wanted to explore a few options. Finding work is not an issue for me.

(a) Ability to open a company and being employed through my company. That way, I can make sure that I have all the revenues.

(b) Ability to open a company with a friend (citizen) of mine and being employed through that company. I would have bit less of revenues.

I'm leaning towards option (a) and I would like to know the pitfalls of each of them.

I know for a fact that United Nations and Ginnu provides tremendous insight on AC-21 issues. I'm sure that they are others as well who have comtemplated this and have some insights.

Thanks everyone!
