Unique situation with priority date retrogression

Friends,
I currently applied I-485 with my spouse in January 2003. My spouse is the primary applicant in EB3 category, with priority date of February, 2001. Since the dates have retrogressed to January, 1998, I am thinking of applying for I-485 with my approved I-140 in EB1-oustanding professor category, with priority date of August 23, 2002. I see the current priority date for EB1 is August 2002. Do you think I can apply for I-485 because my I-140 priority date was August 23, 2002? Also, what problem would it create as I am already have applied I-485 with my spouse (my spouse is EB3 category)?

Any help will be greatly appreciated.

You can apply before the end of month. I am sure EB-1 move very fast.

talk to the lawyer. you don't have to file 485 again. what are the ND, if your name check is cleared you could interfile against the old 485 and if luck favors get approval this month
