Unique Situation in AC-140

I am planning to apply to (new delhi consulate) AC140 as the wait of 485 is getting pretty ridiculous. But there are a couple of things that are holding me back.
1) Mine was a labor substitution case, don't know if that makes a difference.
2) I had acquired PR status of canada few years back and my indian passport is issued in Toronto (never thought at that time that this could cause an issue). Now will this raise a flag at the consulate as they may not issue immigrant visa to US as I am already a canadian PR.

Any views on the above issues will be helpful

AnsweR: Does not make a difference!

Answer: I personally dont think this would be an issue! Having permanent residency of Canada or for that matter any country is not a reason for not given US PErmanent residency!

What will definitely come out of this is that for sure you will have to give up one of the permanent residencies since there is a teim clause with all GC's where one needs to stay in that country for certain time of the year on a regular basis. And one person cannot stay in two countries at tthe same time. So I am sure that quesiton will be asked!

Definitely consult a lawyer on the 2nd question!

Thanks for your reply, can someone suggest a lawyer who is experienced in dealing with consular processing issues and may have an idea of how to deal with this Canada PR status.

Rajiv Khanna for sure...if you need a choice then you can try Sheela Murthy/ Ron Goetcher!

I will personally recommend Rajiv Khanna! BTW...you are currently on his web site! Click the immigration.com home link above to get his contact information so that you can discuss with him/ his paralegal team about pr status for canada and simultaneous cp process for usa!
