UNIQ SITUATION: 1 more year on H1 and would like to move

Hello fellows,
I might have a unique situation here. I will break it down in bullet points to make it easier:

  • My fifth year of H1 B quota comes to an end this May of 2007. My current employer is in the process of filing my labor application, which should be filed before the 6'th year starts. By law, I should be fine here for a 7'th year extension.
  • In the past, I have had two employers file for my green card three times (the first had to file it twice from two different locations.), but I left their firms before the processing completed. The first time the labor application was filed in 2001, second time in 2003, third time in 2004. I understand that the second labor application got approved sometime last year but it doesn't matter now because I am no longer with that firm.
  • Meanwhile, I got maried and got added on to my wife's I-140, which got approved last year. This is an eternal wait for the 485 to get current so we are waiting patiently.
  • And now, I might get an opportunity to move to a better job, which means I have to leave my current firm and the labor process as well.

So, here is my question - Is it possible for me to use any of my previous labor filing dates to get the 7'th year extension? If the answer is NO, then can use the I-140 approval (from my wife's applicaton) to get the 7'th year extension?

If the answer to both my questions is in negative, then I will have to wait until my new labor gets filed and approved before I could make the change and I might loose the new opportunity in this process.

I apologize for a lengthy read, but wanted to make it very clear.

Thank you,
Rakadh
