Unemployment Benefits for Dependent

Hello All,

My wife has been working for the past 2.5 years in U.S. She was filed as a dependent with my GC Application. We currently are working on EADs.

She just lost her job. I wanted to know if my wife can claim unemployment benefits? If yes, is it going to affect our GC applications in any way??? Is it a good idea to claim unemployment on EADs.

FYI: It has been 17 months since we filed our I-485.

The only risk that exists is once the unemployment claim is filed, EDD will need to check your immigration status (e.g. green card A#, or EAD card# will need to be provided). INS will know that your wife has lost the job immediately.

If your wife's I-485 has been pending over 180 days and your EAD card is still valid, it should be OK, otherwise, INS will probabaly turn down the AOS based on their knowledge of your wife's loss of employment before the 180-day limit.
