Unemployment benefit (Urgent)

Hi I need help. I will lose my job end of this month after 180 days of filing I-485 with RD in10/2002. I think my case will be reviewed at least for a year. I know I need get the same or similar job as soon as possible. I want to know that is there any negative effect if I apply unemployment benefit during these period. I am in Minnesota where I am eligible for these benefit. My concern is that if the INS has way to know that I am out of job and reject my I-485 petition or trigger RFE immediately.

it could be problem with 1099 U form

if you have hard luck and you get interview from INS, generally by rule of thumb, people takes thier w2 form, but if you used unemployment, you will get 1099-U form end of the year, and it will create problem in interview or whole green card process, becuase gc is future job and if you don't have job then the GC process is dead, and other thing about AC21 interpration to not be public charge, if you take unemployment, you might ran in to problem. You may get away with it, but i think it is full of risk and i would try of thinking.

Don't do it

Hi,
Don't even attempt to claim unemployment insurance as the Workforce commission will pay you only if you have a GC at the least. They will ask you for all pertaining documents and run it by INS- and till you get the GC, "you are not authorized to work for any other employer".
It happenned to me (luckily just after I got the GC-got laid off before but waited to close the loop and then applied) and they gave me hell before I could start receiving it to the extent that I had a Workforcw commission hearing to prove (with all legal documents in place) that I was a GC holder).
My suggestion- if you can hold on in the country and keep applying, else take a cool trip to India on Advance Parole (make sure you carry it and have a valid EAD) and come back once you get the I485 approval letter-You can have it re-directed to a friend's place and that way not need to keep your apartment).
The day you get your GC stamped, go ahead boldly and apply for unemployment the next day- you might face some hurdles but can overcome it.
I am again laid off after a year and am now looking out.
