I think some states provide unemployment benefits for H1 and EAD holders
can anybody explain if following states provide unemployment benefits

1. Wisconsin -
2. Iowa -
3. Minnesota -

Where to check if this is even applicable? I remember a while back there
was a heated conversation going on this topic and some experts gave
their strong "positive" opinions. Please update on this.

If mohmad atta can get his INS approval anything can happen. But only thing if you take unemployment compnesation, at a later stage it may have its own impact on your naturalization/citizenship stage.

Bye the way are you a pauper

yes, I am. Or you may think so. Aren\'t we all? We may have seen plenty of

penny-pinchers on this web site by now, langauta, ghhewalas and lotiwalas. by the way, i am not a pragraaamarrrr.

Public Charge

Public charge is defined as "primarily dependent on the government for subsistence." As far as collecting unemployment benefits are concerned, it is a factor that INS will look at but it is not automatically disqualifying.

Under the Immigration & Nationality Act ("INA") §212(a)(4), any alien, who in the opinion of the consular officer at the time of application for a visa, or in the opinion of the Attorney General at the time of application for admission or adjustment of status, is likely at any time to become a public charge is inadmissible. Additionally, under INA §237(a)(5), any alien who, within five years of date of entry, has become a public charge from causes not affirmatively shown to have arisen since entry is deportable.

H-1 workers cannot collect unemployment benefits since they are legally required to leave the country immediately upon termination of their employment and since they need sponsorship they are not qulaified to work for any US employer.

Easy to say to you.....

Wonder what you\'d say having no money to pay a rent, or having another job (not immigration attorney...)

ok Jim. How about EAD holders?

Same situation?
worked as H1 but got terminated and has EAD as a backup, I suppose this is considered \'purely an H1 case\' (even has an unused EAD) and not eligible at all, is that right?

This is unfair to INS

I think everyone should realize that the two terrorists were approved before the actual act. But since INS used a contractor to mail the approvals and there was a frontlog problem, they got their approval after they died!

Mohd Atta had atleast balls to do what he did but you need to get your genitals checked out before you are given AOS.

Which company gave you H-1/b, if you are stinking Indian go back to your hole where you came from and leave US jobs to white folks.

If you have an EAD

You are eligible to work for any US employer, so you can collect UI. However, if you don\'t have a similar job come I-485 ajudication, per AC21 you will be denied and then have to leave the US.

how about worked as h1 case? never used ead but has an ead case?? I know this is very

tough question, may be you can argue either way. May be Jim can shed some solid light in it.
