Unemployed while 485 is pending

Hello All,

What would happen if one gets unemployed while the employment-based 485 is still pending?

Will it be possible to renew the Advance Parole "AP" and the Employment Authorization Document "EAD"?

Even after 180 days, you may run into trouble. The portability rules of AC21 do not talk about unemployment, so it is pretty much up to the examiner.

Yes, that's after the 180 days. Does the renewal of the "AP" require a proof of an employment?

Also, what if I would be able to find a job prior the decision on the 485?

No, I meant what if I got unemployed for sometime and then I would be able to find a job again prior to the decision.

CIS has not issued regulations, so everybody is in the dark. The scary part is that because of this, each examiner can make up his own rules, so having a lawyer to fight if necessary is definitely a good thing.

Is it OK to be a part-time employee to get the I-485 approved?
 
As far as I know, you should be holding full time employment as
the employment based GC's require full time employment.
