Unemployed when 140 and 485 are pending

Hi everyone,

Need your help and thanks in advance.

I am about to be laid off, and I am expecting, keep my fingers crossed, my 140 in 3-5 months.

I need to spend some time with my family, so I will not be looking for a new job and planning to stay home untill 140 arrives.

My question is whether I can be unemployed while my 140 and 485 are pending.

I believe if u can afford not to work for few months... u are fine with ur pending pettitions till 140 is not approved and you don't have EAD on hand....

Btw.... generly it is not good idea to be here as un-employeed when ur pettition intentions are clear that uare going to participate in ecnomic growth as a employee in return of some award and honur of "GC" ...unless u go to home country or few weeks vacations while u have job and working.


Not sure about ur case... but it would be questionable once u got EAD and I-140 is approved..... based on that u are going to part of work force....


talk with ur attorney about it.
