Hi all,
My case will give a hope for every one who applied concurrent filing I-140,485. I filed my i-140(labor substitute-EB2) on July 3ed. Filed 485 on Sep 18th after getting the I-140 reciept.I applied for EAD also.
Till Nov 18th I didn't hear any thing from INS about my EAD or I140. On 19th I got RFE( educational evaluation) for I140. My lawyer get the RFE notice on 26th Nov and we repplied for RFE on 27th Nov.
INS recived RFE on Dec02 and all the cases(I140,EAD,AP) approved on Dec09th. Hope every one will feel little comfortable about their cases.

Thanks for sharing your case details.

MMR2002 - My hearty congratulations to you. I guess I am currently in the same boat as you were sometime back:

I140/485/EAD/AP (EB2 - Masters) - Concurrent filing with Substitue Labor

RD: 11/01
ND: 11/26
No progress after that!

Thanks again,

Lough or cry?

Well, here are the details of RFE.

My company showed only 19K last year as a profit so INS is now asking that how come they can pay me while they have so little profit. Well, after talking to company VP, one thing became clear that their tax planning is very good. Also they do the tax returns on cash basis (i.e. based on amount in bank at end of the fiscal year) rather than accrual basis. Otherwise they would owe IRS in excess of 2 mil $.

So now, what are the ways to show that the company is profitable enough to keep me employeed? Someone here must have gone through this before.. any comments welcome.

I would guess one way would be to show the ability to pay your wages for a certain ammount of time, with for example, a bank statement showing enough $$ in it.
