Hi friends,

My I-140 and I-485 applied concurrently in May 2004 at NSC service center
using substitute labor.In feb 2005 my I-140 got approved and my I-485 still pending.Recently around 10 people who used substitute labor from the same companny and applied I-140 and I-485 concurrently at CSC service center their cases got denied because of companny not paid the taxes in the year the labor filled at CSC.I also heard that they are not approving any cases from these companny at CSC.So my question is does it effect my i-485 processing in any way since i used the same companny substitute labor but applied in NSC .Can uscis revoke my approved i-140? and can they deny my i-485 if so what are my best options to save my approved i-140 .pl help me as I donot have any knowledge in these matters.I appriciate your

Change employer and file AC21

Hi gcmagic,

If your company has really difficulties, and since
almost everyone from that company got denied, best
for you would be to change employer right away and
file AC21 provided you qualify. In my opinion, it's the best.

Go for a "good" employer, with solid history of
employment and taxes. No need to take a risk.
Look for a job of same kind as filed in your labor
certification. Check with a lawyer as soon as possible
on how to file AC 21. Hurry before they deny your case as
well, unfortunately, this is a real danger.

I don't think USCIS can revoke approved I-140 unless they find some cheating stuff. By changing job and invoke AC21, you could even eliminate the possiblity of your current employer I-140 withdrawal.

Thanks for all your responses.I will wait for some time to see if there is any rejections from NSC .Since there is not even single rejection from NSC for my companny these all rejections only from CSC that to in last two months.

UNITED NATIONS you are telling me that evnthough I change the companny still they see my old employer while they processes i-485.so iam kind of confussed what is the use of changing the employer?pl clarify
