If somebody takes unemployemnt benefits after getting GC
will that be a problme at the time of citizenship?

I heard that, in your records it will show as you took unemployemnt benefit and that may trigger an RFE again during citizenship.

Yud.. think twice before you write something.

This forum is not to play around with the people. Pl. try to make it authentic. I wont write here if I don’t know something. Keep quite and stay away from the words like "MAY"...

There may be some body shoppers or middleman (on bench for long time, left programming and trying to fish some programmers) on this forum trying to scare the other people and trying to take advantage of their situation by spreading roomers. They may be misguiding others so that they can trap the fish for longer time. Also with my knowledge, unemployment money goes from the employer insurance (that they have to pay and the insurance may go high as they layoff more people.)

I know a friend filed for unemployment during 485 process for period of 6 months when he was on bench. He recently got a project and approval too.

According to my knowledge, its no harm to file unemployment.

Interesting...Never heard that. As far as I know, an approved GC holder's unemployment is nothing to do with the citizenship. Your statement is correct when a person's 485 is pending and if he applies for unemployment benefits.

During citizenship, BCIS will be interested in knowing why the applicant left the employer who processed the GC. If that applicant is laid off, he/she should be fine because it is the company who shown the door to them. If the applicant resigned on his/her own will, then they have to prove why they left the employers. Most of the lawyers suggestion is stay with the employer for atleast 6 months after the approval.

Thanks everybody.

I think bottomline is,
After getting GC try to be with the same employer at least
6 months and if got fired and then try to find another job
and file for unemployment Insurance benefit from state
without worrying about citizenship or any other issues,
if you are not able to get job for the 'buffer period' that
you have allocated money for. This buffer period may vary for every person.

I also asked some questions somewhere else in this forum but
could not get good answers but are in the same context.
I would appreciate if someone has some answers to those

1. After getting GC if employer fires you within one month
will it be a problem for citizenship?

2. After getting Green card is it good to change the
address before getting plastic card? Will the
address change may have any problems after passport
stamping and before getting plastic card?

3. If after getting GC you are with the same company
with no intent to leave. But the company is paying
'considerably' less than it said in LC document
can you sue your employer or somehow do
something to get same salary as mentioned in LC?

Thanks

No, maintain clear documentation just in case.

You could always do that, all you need to do during your I551 stamping is to give them the new address. Also you need to send BCIS AR11. But having waited so long for your approval, I wouldn't suggest you take that risk (BCIS will most prob. send the card to your old address) of chaning your address.

Do you really want to go down that path. Instead talk to them, raise your concerns, it can always be sorted out.

Ans. I dont see any problem. (INS is not working only for you.) Its very hard to revoke your GC unless you have some criminal history or you have lied (Big lie) during your GC process.

Ans. File AR-11 and you should be fine.

Ans. Its not that easy to win the case. When you throw a mud on someone, he will do the same. Think twice before doing that..

After getting stamped in the passport, if you plan to change the address u need to file what is called form G731(please fill the second page of this form). Actually I asked this question when I went for stamping at Newark, NJ and they gave this form to me.

I sent this form to VSC on Sep 1st. My wife got her plastic card on oct 14th to the new address. Initially I was suspecting that the card might go to my old address. But luckily it came to my new addres.

Hope this helps.
