UI benefits affetcts my green card application?

Hi,

I am in the stage of filing I-485. There is a question in the application: "Have you received any public assistance in US from any source?". My wife applied and got UI benefits two years ago when she was laid off. My lawyer said that counts for the public assistance and needs to be reported, how serious will this UI benefit affects my green card application?

A little background on that UI benefit: my wife was having TN visa when she worked and she converted to TD when she was laid off. When she first applied, the officer at EDD didn't give her the benefits, then we argued about TN is different than H1, the officer then talked to her boss and came back to say the benefits are granted. Will expose that UI benefit in I-485 application trigger INS to dig up and question whether my wife is legal to receive the UI?

I do not know the exact answer but if it is insurance it should not be a problem. Search for Murthy's chat. She mentioned this in her chat.

The undecided Question is UI is an insurance or benefit?

You did not clarify what kind of 485 you are applying for (employment based/ relative) or the timeline (UI applied before marriage or after?)
 
Since UI is not paid by government but by an insurance fund, it is neither public assistance nor is it a disqualification for AOS.
