UEGENT - H1B for FY 2010 - Can I get it after Oct 1, 2009 ? What Start Date Shoul I tell EMPLOYERS?

Dear Advisor,

I am working in a University on H1 visa ( since 2 years).
I am very close to getting a job offer. I am being asked what is the best date I can start to work.


Though, I doubt that offer would be made before OCT 1, 2009.

let's SAY:


If offer is not made before Oct 1, 2009, And if it is made sometime in December 2009 ?



Then does that mean:

a. I can apply for new H1 visa anytime in 2009 even after Oct 1 , 2009 ? for FY 2010 ?

b. OR Do I have to wait till April 1, 2010 to file for new H1 ( to start Oct 1, 2010 ?)

c. Since the CAP has not been reached for FY 2010 is my Current Cap-Exempt H1 transferable after OCT 1 2009 ? ..



If yes, Can I start working in DEC 2009 or so ?

(Now since Quota is not depleted Can H1B can be transferred from Cap exempt top Cap Subject ?
If yes is this ANYTIME AFTER OCT 1st ?


OR EVEN AFTER APRIL 1, 2010 ( can a transfer be possible to let;s say start working in MAY 2010) ?



Employers, are going to ask me very soon, when can I start working in the interview itself and I am curious.

What kind of simple One line answer I should give them ?


This information is the most critical information a manager OR a Naïve OR novice HR manager needs to know. Because most of them in my experience are not lawyers and have No idea how this works.


Please help me in figuring out what should I tell them, to best of my knowledge.

I do not want to Jeopardize the chance of an offer, so please help URGENT !
