U.S. Status Change / Re-entry Options

Hi,

My family and I were called for the interview at home for the Green Card / Immigrant Visa my Father applied for years ago. Because I'm also attending college in the United States as a Student (F1 Visa) and had to attend class, I returned to the United States after the interview. So while I'm in the United States, my F1 visa was cancelled and now have an immigrant visa instead. My father (the lead applicant) entered the United States recently, and now I'm wondering if there is any way to change my status without having to leave to home and back (It's a long way and expensive). Is it possible?

I don't know if reentering on the F1 when you had an immigrant petition can be considered fraud, however I doubt it particularly if you were honest in all your statements with immigration at the point of entry and when you went for your interview.

Hopefully experts on the forum will show you ways to change status via some forms however you can also fly into Jamaica, enjoy the sunny beaches, and then reenter in permanent resident status. Cheaper than flying back to wherever you are from. You just may only have that option since the rules require the principal applicant to enter first.

You also want to make sure you're not accumulating any illegal presence since you indicated your F1 status has been voided. That can cause problems if you need to leave the country and reenter.

What? You can't get an immigrant visa inside the US.

Please clarify what happened. Did you leave your passport at the consulate after the interview? Or did you take it with you after the interview, then used it to enter the US with your F1 visa, then sent back the passport to the consulate after which they canceled the F1 and stamped the immigrant visa in it?
