Types of RFEs

Hi,

Can an elaborate listing of different types of RFEs and the standard ways to respond to them be taken up? This could pro-actively help people who'd rather use this list as a reference right away than wait for replies from the forum.

1. Education Evaluation: Get educational evaluation done from atleast 2 different evaluators. If possible, get a letter from the university stating that the degree is equivalent to the degree in LC.
2. Missing items: This should be simple to answer.
3. Change of category: In 140 one may get a change request from EB2 to EB3. Generally, you should agree for the change. It hardly matters in reality if you get approved in EB2 or in EB3. If USCIS is happy to change it, you should not have a problem.
4. Birth Certificate: If the birth Certificate is not correct. Get affidvaits of Birth from relatives etc.
5. Photographs: You will get these for EAD / AP. Get correct photographs.
6. Company's ability to pay: Very common RFE. Should reply with CPAs statement about company's Cash Flow Statement, File Tax Returns, current business trends and show how the company can grow and how the company is meeting its current financial committments. If there are newspaper clippings about company's business, attach these also. These should be neatly organized with the help of a cover letter and arranged in logical sequence.
7. Missing Experience: Explanation of missing information in 325 (Applicants Biographic information for 485 etc). Find out what is missing by referencing copies that you filed and respond with an apology letter / explanation of why it was missing. USCIS is OK, if you have made a mistake in providing some information, as long as you are willing to correct it. Always provide proof for new information like relevant pay stubs etc.
8. Marriage Certificate: For dependents.
9. Felony etc: If you have provided incorrect information. Especially if you commit a mis-demeanor after you filed 485. Provide explanation. Better avoid speeding tickets and if you get it, pay fine or take defensive driving classes to get them dismissed. If you have a 485 pending, don't drink and drive for 2 years. If you do, don't get caught.
10. Withdrawl of 140: If you use AC-21 and did not inform USCIS, you will get a notice of Intent to Deny. Treat this seriously and provide AC-21 cover letter from your new company HR.

These are the ones I can think of .. keep adding more. :)
