Two Labor process

Hi,

I have two labors from two different employeers...

My labor from first employer has approved ...

now my qustion is can I apply for i-140 thru both ?

I applied for labor in jan 2007 and after waiting for more than 2 years it got denial in feb 2010 and I will be completing my 6 years of H1B in march 2012. However my employer has filed for appeal for my first labor. Reason of denial is wage was not written in notice of job listing. My job title for labor was Computer System Analyst and requirement was BS+5 yrs experience for EB2. Now I want to apply another labor through same employer with different job Title Project Manager with Masters+ 0 yr experience. I have 8 years of experience in USA + Masters from USA university. I want to know, is it safe to apply for second labor through same employer for different position while an appeal for first labor is in process???

Please help me in this matter.

It is better to get I140 approval before labor expired (perm labor expire after 6 months). if I140 rejected after labor expired you can re-appeal. if you can not re-appeal then you need to apply perm labor again. company needs to prove financially good enough to pay you as per perm labor. they may need some time to get that information. but the is no waiting time.
