Hi,

My labor certification is in process (EB3/RIR/PD:Feb'04).

I was wondering if I could file another labor certification in PERM using a different employer.

Scenario: Currently employed by a company A, labor filed in RIR/EB3. Filing another labor with company B from another state in PERM.
Lets say my PERM labor gets approved before RIR one, what am I supposed to do. Do I need to join company B and file for 140 with them?

Does it matter from which state you file your 140 from? if yes, which one is the best bet?

Is there any provision for 7th year extension in PERM in case, my 140 is still in progress with company B?

Please advice.

Thanks

if Perm Labor is approved, if you want to go for GC with company B, you dont have to join company 'B', provided company 'B' has the ability to Pay , for which labor wage mentioned, It is upto you to join or not to join company 'B'. From which state you will file ?? depends on Labor approved State, I believe it should be applied in the same jurisdiction...
