I have this question lingering in my mind, can the employer file two I-485's for the same employee on under EB3 and the other under EB2 with same skills set eg:Java.
My case is as follows:
1. Filed I-140 using LC substitution under EB3 (skills:Java) April,2006.
2. I-140 approved in Oct,2006.
3. Filed I-485 on July 2nd,2007 ( did not get receipt as of July 18th,2007).
I have a EB2 LC filed in my Name (PD : Feb,2005, Same employer as EB3) and approved around oct,2006.
My question is :
1. Can I file my I-140 using my EB2 LC now?
2. Will USCIS allow filing another I-140 & I-485 under EB2 thru same employer and same skills (Java)??
Please reply at the earliest. I have time until Aug 16th,2007 to file I-140 only or I-140/I485 together under EB2.
