Two I-485s same time?

I have an unique situation. I filed an NIW based I-485 with TSC in 6/01 per INS instructions since my self petitioned I-140 NIW was approved by TSC. I am now working in CA. Just learnt from my company attorney that my company sponsored I-140 was also approved. Since CSC is much faster in I-485 processing than TSC now, can I file a new I-485 based on a new I-140 with CSC and keep both I-485s (to see which one comes first). I heard from somewhere before it is not allowed to have two I-485s pending but my company attorney told me it was OK. Can anybody share their experience? Either way, where can I get official confirmation from INS on this if possible?

My Lawyer says it is possible. at the worst, if INS says to withdraw one application, you will have to withdraw it. But I read somewhere(can\'t recall where) a posting by someone saying his second application was rejected on the grounds of "waste of govt resources and money..." and the first one resulted in interview. Although he said he wasn\'t sure whether the interview on first application was in any way the effect of second application. I personally don\'t think that 2nd application will have any effect on first. Based on this, I decided to wait and see what happens to my previous application(applied in April at VSC) and then use the second I-140 if needed(God forbid). Also, I have seen many lawyers taking different position on this issue. If I find anything else, will let you know.

I too was told you cannot have two AOS applications at the same time. The service center may reject any one of the applications.
Better to wait for some time as the other I-140 is valid as long as you are in the same job.

Thanks for your information. I know TSC has a memo applying to your situation. They allow concurrent I-485 filing (spouse and principal as dependent of each other). I am not sure about other centers like CSC though.

I am in a similar situation...How about this solution.
File individual 485\'s each and not filing the spouse as the dependent.
At a later stage add the spouse application and withdraw the other 485??
You can basically use the 485 that first comes up for review and withdraw the second one.

Any comments?
 
I did file two I485 as my lawyer told, so far so good. One has been files for 5 months, another al

 
 
You can file whatever you like, the question is "is this the correct way to do it?"

Could you please explain a little bit more. Are you filing two I-485s based on two your own I-140s? Or one yourself and one spouse? Are they filed with different service centers or the same center? Thanks.

I believe there is no regulation forbidding doing two I-485s at the same time. It is more like a question of intent.
