Two I-140s based on one labor - Is it possible?

I filed I-140 in EB2 which got denied. I have an MTR pending. I was wondering if I can file another I-140 in EB3 without withdrawing that MTR.

Is it possible? Please help. Thanks.
 
Not sure about your situation ... I can recall there were postings about RFE that suggest to re-file as EB3. In my opinion, it is safer to file another LC followed by the corresponding (correctly matched) I-140. The MTR will buy you time (for H-1B extension, new LC) anyway.

thanks for your reply. I am starting a new application but I was hoping to rescue my first one. It has priority date of June 2002 and it appears to me that priority date is going to become very important pretty soon. But it seems like I am doomed :-(
 
i have filed another I-140 under EB2. Now, this I-140 still pending even I already have my gc.

My case is different from your because you filed MTR for your other I-140. So not sure what to tell you.
