My wife is a derivative asylee (her father was the primary applicant). She applied for AOS in July 2003 and in June this year her case was transferred to a local asylum office for the nunc-pro-tunc processing, because she got married to me in 2004. In the meantime, she also filed 485 based on my employmnet based visa status (L1-A) in June 2006. Although she did not apply for EAD or AP through my case.
We are planning to visit our home country and the COP of her father in December this year. Should she apply for AP through my case, and RTD through her father's asylum case and keep both just in case. Would it be a good idea? Because in case if she has any problem coming back using her RTD, she can use AP (approved through my case).
And also, does just applying for AP through my case going to jeopardize her asylum case or using it will?
