Two companies under same ownership

Hello All

I am working for a company ABC. They have physical stores, offices, warehouses in NYC and they have registered another company for the Online shopping web site.

So the original company is "ABC" and their online company is "ABC Online". This difference only exists in papers. As any shopping done from the online web site gets the items from the stores, warehouse etc.

Well, my company filed my I-140 using the company "ABC Online". Their last tax returns (for ABC Online) were of 3 million dollars. But they showed a lot of expenses to reduce the tax etc and made their profit very close to Zero.

Can i use the Tax returns or income from company ABC for I-140 if i get an RFE? (which looks very probable).

Both companies have the same ownership and both are S-Corporations.

Please let me know as soon as possible.

I understood from your email, that ABC is financially strong and has good profitability, but ABC-Online has 0 profit.

The following is what I would suggest. Your employer should draft a letter which explains the relationship between ABC-Online and ABC - something to the lines of ABC-Online is a subsidiary of company ABC. Then provide information about ABC with regards to the total # of employees/sales offices/etc including those of ABC-Online. Then provide all the finanical results of ABC. If you could provide Annaul report and Form 20-F of ABC, that would be ideal.

I agree with the above (inc. the lawyer suggestion!!! ;) ) but i'd also point out that the USCIS are aware of operating losses for tax purposes and provided a salary is listed as an expense i dont see a problem. Also if ABC is a subsidiary then the parents info 'could' be used. But yeah get a lawyer to check both the company's docs.
