two 485?

Hi, guys:

I need your help!

My situation is as following:

1). My wife's 140 (EB-3) got approved in 2004, then both of us filed 485 in 2004.... then wait.....

2). We both used AP during this time, but both have H-1B all the time.

3). I filed 140 (EB-1a) in 2006 and got approved last week.

What should I do now? Should I file a new 485 application for myself and one for my wife with this new 140? Can we do that? Anything we need to pay attention to? Any other options?

Hi!

You can relink your I-485 (filed under eb-3) with EB-1 to retain your PD. You need to send a letter to VSC/NSC/CSC/TSC (whereever your files are) requesting the service center to relink. That way your 485 will be adjudicated quickly since your PD will be 2004. OR you better hire an attorney for this purpose.

Can I? This is wonderful, but my concern is that the original 140 is for my wife and I only applied 485 as a spouse. In this kind of situation can I do this "re-link"?

Also, my 140 was approved by TSC center, while our old 485 was filed to VSC in 2004, where should we contact regarding the re-link?

Better to call TSC and see what they are saying. Hope, they will relink. Also double check with VSC too if your I485 is pending there they should forward to TSC.
 
Thanks for the advice. Do you guys have the phone number?

Also, the lawyer at my wife's company filed the previous 485 for us last time. Do we have to ask that lawyer to call/mail a letter to TSC/VSC? or can we do it by ourselves?

Yes

Yes . I did for myself and now both the files are with the same center and connected. However I filed one 485 in Nebraska and otherone in Vermont but Vermont connected themself and send my file to the old petition which is in Nebraska. It works..

That is great news! How did you do it? Did you write them a letter with copy of your 140 and 485 receipt? Where to mail the letter?
