TSC processing July '04 now!!!!!!!

The dates seem to be moving along. The only problem is that more and more of us will now feel worse because our cases are now officially delayed. Maybe October will be a good month for many of us EB3s.

You are right, saras. Unfortunately (or fortunately?) my friend's 485 had a LUD yesterday with an RFE. She hasnt called the INS yet to find out what this is regarding... but will keep you guys posted. I was telling her that in a way, this is good news, that at least, they opened her file! Of course, it would have been much better had she received an approval notice, but life tests you and your patience in different ways.. :)

By the way, she moved from FL to NY after > 180 days on her 485 and didnt file AC21. She did file AR11 with new employer info. Hope thats OK.

Let's hope magic will happen in October. I'm a victim of INS, former lawyer and doctor. I encounted all worst cases.

Here is my info:
PD - 5/15/2002
Labor Approval - 12/30/2003 EB-2
I-140/I-485 concurrently file on 3/30/2004 , unfortunately my former lawyer accidently file my I-140 as EB-3.(how bad lucky I am)
FP - 10/23/2004
I-140 -AD(12/14/2004), because EB-3 I485 backlog, my I485 was not concurrenly processed(my new lawyer told me this, miss concurrent).
Company changed law office, my case transferred to new lawyer on in early May 2005, G-28 filed to TSC.
I-485 - RFE issued on 6/1/2005( got automate email notification), but none of my former lawyer, current lawyer and I received it until 7/26/05 my current lawyer called INS, INS people faxed RFE to her. ( unfortunately, INS didn't change my lawyer to new one, RFE was sent to former lawyer, but former lawyer moved to a new office, miss a good chance again, starting from 7/1/05, EB-3 has no quota)

RFE:
my case: employment verification letter, non-immigration status evidence to support my first date entered US till the date I got my first H1B, completed 693 medical examination form (the doctor provided HIV and Syphilis test result sheet, but she didn't check the two boxes of HIV and Syphilis results on form 693, how bad lucky I am).

My husband's case: no-immigration status evidence to support his first date entered US till the date he got his first H1B, form I-864(new lawyer told me employment case only needs to file I-134 instead of I-864).

RFE sent back to TSC on 8/3/05, both my and my husband's I-485 get LUD on 8/5/05 to ack RFE.

I'm hoping next time I got emails from INS are approval information. If nothing happens in early October, at least I can inquiry my case.

Let's keep fingers cossed.

The Busy Doctor

A young doctor had just opened office and felt really excited.
His secretary told him a man was here to see him. The young doctor told her to send him in.

Pretending to be a busy doctor, he picked up the phone just as the man came in. "Yes, that's right. The fee is $200. Yes,

The date have no meaning for EB3 category of retrogressed country

The date are fussy mathematics of administration and has no value for people in EB3 category from retrogressed country.
I happened to call 1-800 to change my address. The lady there was giving me false hope of raising a query to get my I-485 approved. I told her many times the funda of PD but it didn't go in her head. Later I quit.
 
Still this is good sign we can crack them down, do inquires, send congress man/woman letter...

June-July 2004 Filers, Guys roll up your shirt sleeves and start banging them out.
 
They are supposed to process most of the cases within 6 months before September 30, 2006. That is the USCIS goal.
