Trying to switch TN

Dear friends,

I got my second TN recently approved, this time I was kind of questioned and lectured by the officer at the border because he said TN is just for temporary purposes, he finally gave I to me. I would like now to consider my chances of applying either for I-140 or I-485 and try to avoid these hazels at the border. I wonder what my options are, I think that depends on specific cases. I am a Canadian citizen; I was born in South America. I am an electrical engineer, got my BSC in my own country and a MSC and PhD in France. As TN is only valid for one year I wonder what would be the steps I’ll need to follow in order to try to get a more stable situation here. I might to renew my TN again?, Is LC process costly and lengthy?, it probably demands educational equivalences or something like that?. Concerning I-485 I wonder what my options are of being approved if I apply it before I-140?

Thanks in advance for your thoughts,

Regards,

Joseph.

You can try to apply for an H1b, and then apply for LC/PERM, then the I-140 and then the I-485. If don't want to wait to switch to H1b, you might want to read the second post on this thread:

An "adjustment of status" i.e. an I-485 must be based on an "immigrant petition", usually an I-140, or an I-130. You can't file an I-485 without an I-140.
