Hi,
I work in one of the big indian IT company having over 8years of experience in IT field.
Was Travelling to US since 2003 and in all cases thru L1B visa.
- Jan2003 to May2003 thru L1B
- After that Spent nearly 8 months in India for the same company/project.
- Feb2004 to Mar2005 thru new L1B.
- Went on 1month vacation and from Apr2005 till date in L1B
- Visa stamped till Mar 2006, I-94 valid till Oct 2006.
Since my company is not processing my GC, I've finally decided to come out.
I've applied my H1B thru Company B. Filed on Aug-9-2005. Received the receipt after a week. Now the case is with USCIS.
My Questions:
1. Once my H1B approved, will my present L1B gets invalid ? (my lawyer told that I've 2months time to join company B. Else Company B will have to cancel H1B)
2. For some reason, if I'm not joining CompanyB, can I still be in US with L1B working with my old company.
3. Say If I get my H1B approved, can I go to Canada for my H1B-Visa stamping ?
4. Worst case, if my H1B-Visa gets rejected in Canada can I re-enter US, with my old L1B-Visa which is still valid till Mar-2006.
5. Did any of you were in same situation, could you please share your visa stamping experience.
6. Quiting my present company which is having my L1B, and joining CompanyB thru H1B, will it make any harm on my GC processing ?
