Tricky Situation: Change in job functions

Hi,

I am facing a tricky situation and was wondering if any of you have faced a similar situation. Any guidance or information about personal experiences on such a situation will be highly appreciated.

My present employer, who has filed for my green card, has offered me a higher paying job but with completely different job responsibilities. I-485 and I-140 were filed in February 2004 and I-140 is already approved.

Has anyone faced a problem or RFE regarding job responsibilities?

What if I retain my present job title along with the new job title and continue with some of the present job functions (less than 10% of my total time) in future?

Best regards,

Bala

Theoreticaly you have to work with same or simillar resposibility. If you work with the same company I guess there is no big problem practically if they can support you on this. I have not seen RFE asked job responsibilty directly however EVL is common, which need to indicate your title and it is necessary to give more detail.

probably if u switch companies u can use different titles. If u stay with same company try and maintain the same title if u can. Bottomline is your job function should translate to the same labor job code . If u continue with same employer and u are asked for a EVL just ensure your company can give a plain and simple letter stating that u are a full time employee and the terms and conditions are the same as per the terms listed in the immigration petition. This way u dont contradict or provide fodder for further investigation.
