I came to the US on J1 Visa and got it changed to H1B. I have the approval notice and I did not get it stamped on my passport. I have to go to New Delhi for Consular Processing of green card. Will It be a problem to travel with my visa expired and just the approval notice in hand ? Will I need to take a transit visa for the country I will be travelling via ?

Thanks

I am a little confused coz on one hand you say that you have
H-1B approval papers but then you say you have an expired visa.
I am assuming you meant your visa stamp on the passport has expired but you have a valid H-1B approval paper. If this is the case, it should not a probem with CP interview. Same is the case with me H-1B stamp in passport is expired but I have H-1B extension approval.

As far as transit visa is concerned you will need to check with the embassy of the country you will be transiting from. Lets say you are flying out of usa into paris, france using delta/ air france ... first off check with the airlines and most important...check with french embassy and they will be able to guide you. Since these transit visa rules change by the month.

Thanks for the reply. My J1 visa stamp has expired. Its really helpful.
When should I expect my interview at New Delhi for CP. NVC cashed my fee bills on 7.14.03. Do I need to have I-134 for my spouse and son. I have already paid $335 fee to NVC. Will I need to pay another fee at the time of interview too. Can we pay the fee in US $ in cash or do we need to get a draft made.
Mucho Thanks

You need to send $335 money order/ cashier check to St. Louis for each GC applicant. (1 for you, 1 for your wife and one for your son if he needs a gc). After encashing $335, NVC will generate and mail Packet3 to your attorneys (about 2 weeks after encashing). You return the PAcket 3 to NVC (1 week mailing). NVC will review the P3 (about 3 weeks..although NVC claims 6-8 weeks). Then NVC will mail th packet to consulate in New Delhi (2 weeks mailing plus consulate entering in the system). In another 4-5 weeks you will get packet 4 with appointment date. Actual CP interview will be in another 5 weeks. So you can expect cp interview about 4 months from the time of encashing. I would guess around December03/ Jan 04....with a slim chance of Nov 03.
Onbiosuly this is assuming everything is smooth sailing.

Yes, you will need I-134 for your wife and son. One each per person.

If you have paid for yourself, wife and son in usa then you just need to carry receipts for your cp interview as a proof that you have made all necessary payment (i.e $335 x 3).

Fees paid in usa cannot be cash. Money order or cashier checks only!

Hope I have answered all your questions!

Once you are paid the fee bill here, you don't have to pay it again.
You will get the packet 3 with forms/instructions. Also your attorney will guide you to fill up the required forms.

I would suggest you to post your questions in 'Consular processing - New Delhi' for a better response. Also you find the answers of lots of question which may be helpful to you.

Thanks
