1. My I485 is pending and based on that I have obtained Employment Authorization Document - EAD, which has been renewed once before.
2. During the second time renewal earlier this year, although renewal was approved and the attorneys got an origianl copy of approval valid till 2012, I have not received the EAD card and my origial approval letter. USCIS online status says it was mailed, but I never recieved it.
I did call USCIS and they have opened an investigation.
3. In the mean time, my present EAD card has expired.
4. I do have a valid Advance Parole - AP.
5. I do not have a valid H1B, stopped renewing it ever since I got the EAD.
6. I asked the attorneys to file for another EAD replacement card/renewal, which they did this week.
I need to travel to India and return back to the US in December 2010. Can I enter the US legally with just the AP, attorneys copy of the EAD approval document, but no EAD card and no valid H1B, and perhaps documentation on USCIS correspondence about the lost mail ?
My wife has the same problem ( she got her EAD as my dependent, but she does work as well ) and she will also be travelling.
Are the officers at the port of entry going to ask for my EAD card ? If they do, is it sufficinent to show the attorney's copy of the origianl EAD approval document ? I can also carry letter showing proof of employment.
