Travelling while AP is pending

Hi All,

My wife has a valid AP until Dec 2002. She is applying for the renewal and at the same time will be travelling outside the country using her current AP. Is it allowed? In the I-131 instructions, there is a statement:

"Departure from the United States or application for admission to the United Stated before a decision is made on an application for an advance parole document shall be deemed an abandonment of the application."

If you have any experience on this, could you please reply?

It shouldn't be a problem if she is going to enter back with her old AP. In other words if her old AP is valid till she returns to the US, you are fine though another AP is in process.

This is my opinion and it's always better to consult any critical issues with your lawyer
