Travelling very Close to Expiration of HIB

I am on the 6th year of my HIB. My HIB expires in the secon week of Nov (precisely the 10th of Nov). However, I have to be in India on Sept 26th for a very important family reason. I plan to be back on the 25th of October. This means that I will re-enter just 3 weeks b4 my HIB visa expires.

Do you think the INS officials at the port of entry will give me problems if I come back so close to the expiration? Please tell me your expiriences. Please reply before I travel.

I have filed I485 and AP and they are still pending.
 
I'm assuming since your 6 years of H1 is getting over, you'll be using your EAD to work. If so, use Advanced Parole to re-enter US
 
See if you can check with your employer/attorney dealing with AP to expedite the AP papers. If you get your AP before you leave then there is no issue.

If not just let the INS at the port of entry know, if questioned about the short duration of visa validity, that you have applied for 485 and EAD and AP and they are in process at Texas SC.

I have a feeling most of the them know how slow TexasSC is, and you should have no problem.

In fact when I travelled from Canada on my AP which was expiring in a matter of days, INS was very understanding and helpful. In fact they nicely explained to me the whole process of using the AP and told me to follow up for my new AP should I need to travel out of the country again in future.

All in all, if you have nothing to hide from the INS, you should just relax and truly tell them whatever they need to know.
 
I have done that twice, once at Charlotte & at Houston airports.
You should be okay, just that the Officers can make a remark.
I flew on July 10 '01 and my stamped visa was expiring on july 25th. The officer asked me if I had filed for extension and I told him I will.
In your case, being the 6th yr, you should carry 485, AP receipts.
Legally they can't stop you, you have a Valid visa for re-entry.
If you get your AP by then, you could use that.

Don't worry, As suggested carry all the necessary papers i.e. Receipts.

In fact, when my wife and children were coming from India. Their H4 was going to expire on 14 AUG and they entered US at Atlanta on 30 JUL.
