Travelling using AP

My I-140 NIW has been approved on 04-07-06 at TSC and Im still waiting for my I-485 approval. I'm currently on H1B visa however I also have AP. I am planing to travel to Canada in August to attend a conference. I plan to use my AP when returning to the USA and not the H1B. Thus, my H1B will be expired after returning to the country. I really appreciate your advice regarding the documents that I need to take with myself when traveling. Do I only need to take my AP? Am I going to lose my I-94 form in the passport as I'm going to be a parole? Do I also need to get a letter from my current employer regarding my job? Is this a straight forward process when returning to the United States? Do I also need to check with immigration office at the airport when Im leaving the country? Any detailed information is highly appreciated.

One thing is sure, you do not loose H1B if you use AP. You will loose H1B if you use EAD to work.

NOP. not necessary. If you are maintaining your non immigrant status still you can work with the same employer without excercising your EAD after your foreign travel (using AP to enter US). You will be on parolee status.
 
Hi Everyone,

We are visiting India for 2-3 weeks and we are using Advanced Parole to enter to US and we are traveling via Frankfurt, Germany.

Just today I have talked to Germany consulate they said I have to take transit visa from India for return trip to US.

I have gone through many threads on this topic, nobody said anything about this. Is this new rule??

I also visited chenni (Germany) consulate website and they do not have option for transit visa. Do I have to go to Delhi?? I live in Hyderabad. We are traveling with two kids.
 
If you do not have a valid US visa stamp on your passport you need a transit visa. You should take it from a German Consulate in the US prior to your departure otherwise there might be problems while you are leaving.
 
I really wanted to take transit visa before I leave.

When I talked to Germany Consulate, they said I need transi visa for return gerney (i.e. India-to-USA) and I have to take Transit Visa from India not from USA. Is this is true ???
 
I know someone, who did not have a transit visa for UK, was not allowed to board the flight. He was going through London from NY with BA. I assume it is the same for Germany, but I am not 100% sure on this. I think, it is safe to get visa from here. Do you have to change the flight in Frankfurt or it is the same flight, just stops at Germany? Ask the airline you traveling with.
 
Do not ask the airline. The customer rep has no idea and will give you wrong information. The only person you can ask it the German consulate.

My wife was flying to India from NJ to India thru BA. We called BA and they said nothing is required but on the day of travel they refused to let us board the flight. We told them that BA only told us that no transit is required for which they responded saying whether we have proof of it. But with proof or not they will not let us board the flight. Finally after lot of fighting they gave a free change in date to next week and I had to get a transit visa in the mean time.

You can get a transit visa in US itself. The transit visa does not have to be from India to US or US to India. Like for example UK transit visa we got is valid for a year and we can travel thru UK any number of time either way. The transit visa is not for just one travel in one direction. So advice to get a visa here itself before you fly out.

We have to change the flight in frankfurk. I was under impression that I can get transit visa from US. I will go this week to Germany Embessy and see what would they say.
