Hello Everyone,

I have completed my Masters in EE & my Opt has started on January 19th 2006 & I have an offer letter from a company, but for the FY2006 H1 quota is already over, I can not file for my H1.

I would be travelling India in the month of May 2006, my opt is valid uptil january 2007, so is it legal to reenter US on OPT with a job offer letter????
My F1 visa is valid uptill 08/20/2006.

Any suggestions will be appreciated... Also let me know any extra documents that I will need to carry to reenter US.

Nilesh.

Would be difficult nilesh...you came on F-1 visa and at that time you showed you had no intention to live and work in this country. So they might not allow you to come.

But I know many people who came back in the same situation.

Anyways good luck and I hope everything wil be fine.

From my point of view, I think that it's ok as long as you have your offer letter with you. I talked to the international advisors at my uni and they told me you can travel with OPT as long as you got the letter to prove that you got a job. Anyway, OPT is a job trainning, you're still considered "learning"... use this point to argue with them if they refuse to let you in. However, I heard of some people who are allow to enter even without their offer letter(the immigrant officer didn't even care to ask-->i heard that it depends on which airport you enter). I would suggest that you bring with you somekind of contact number/person from the company that you're going to work, it will help if they question you.
