Travelling to India--I 485 pending, has EAD and AP but H1B expired

Hello friends,

Me and my wife are planning to visit India this Nov. My status is --I 485 pending, has EAD and AP but H1B expired, recently gave FP.

My questions are:
1. Can we travel to India with AP when our visa is not stamped on the passports?
2. Do we need to get our visa's stamped in India?
3. Do we need to take a transit visa for Amsterdam?
4. What if I-485 is denied while the applicant is overseas?

If anyone in these situations have visited India recently and came back with/without any problem, plz share your experiences. I would appreciated your time.

>> I'm not too sure if u can re-enter without stamped visa and with just AP.

U'll get NOID notice b4 485 will be denied. U've 30 days to reply it
and if u fail then 485 will be denied. So dont plan to stay for
a real long time.
 
Q1. You really don't need a visa or AP to travel to India (since you presumably have an Indian PP). The purpose of AP is to enable you to re-enter the US. You do NOT need a US visa stamping (like H/L) if you have AP.

Q2. Not necessary if you have a valid AP when you come back.

Q3. AFAIK, Amsterdam does not need a transit visa -- but the best place to check is the embassy website and email/call them

Q4. Tough one .... hope it doesn't happen :)
 
Travel with AP to India recently

Hi Plzhelp :confused: :confused:

I travelled recently to India (last week of August 2004).

Came to US under J1. Got waiver for 2 year rule.
Got H1 approved but never travelled to India with H1 approved paper.

Applied for I-140/I-485/EAD/AP.

Travelled to India
I did not go to US consulate for H1 stamping.

Reentered US using Advance parole (myself, wife and daughter).

I travelled via Amsterdam. They do not need visa if you are inside transit area.

At port of Entry (JFK), the office ask for finger print (just forefingers) and took me to nearby room.
Waited for 10 minutes and another officer ask for simple questions like where are you working and what is your final destination??

He stamped our passports even before he ask the questions.

Check with respective consulate before transit travel.
You should not have any problem.
